Millerstown Borough Council September 12, 2011
Meeting Minutes
Those in attendance: President Bill Roush, Council members Bruce Hengst, Bill Ritzman and Jackie Minium. Secretary Karen Knellinger, Dave Stroup and Kevin Jacobs from Glace Associates.
President Roush presided, pledge of allegiance and meeting called to order.
Councilmember Mike Sweger arrived at 8:05pm.
Public and Private Concerns
A resident had a concern conveyed to Councilmember Hengst with the drainage on Poplar Street. She would like a curb installed because the water is running into her yard. As everyone is aware, this has been a record year for rainfall and flooding has occurred in every street. A curb would not remedy the issue because the water would flow to another portion of the street, all streets would need curbs or the water will just follow until there is no curbing. The streets would all need to be redrained.
The minutes from the last meeting were previously emailed and reviewed. Councilmember Hengst made the motion to approve the minutes as read. Councilmember Ritzman seconded the motion. Approval was unanimous.
The bills/receipts/expenditures were reviewed. Councilmember Minium made a motion to approve the bills and expenditures. Councilmember Ritzman seconded the motion. Approval was unanimous.
Street Committee Report
An advertisement was placed for the paving on Hemlock Street. The bids received were the following:
Jeff Tate Paving, $13,277.00
Glenn O Hawbaker, $24,375.00
The bids will be reviewed based on the criteria. Councilmember Ritzman made a motion if the bids are equal for Jeff Tate Paving to perform the job. Councilmember Hengst seconded the motion. Approval was unanimous.
Chair Hengst still needs to look at the property on at the end of Locust Street. The curbing on Sunbury Street is eroded; a question was asked if this is State or the borough's responsibility. Chair Hengst will call Penn Dot and ask. There are many potholes that need to be addressed; a list still needs to be done before it is too late in the season.
Sewer Committee Report
There was an overflow from too much rain that was reported to DEP. An air compressor needed to be replaced. The lower end of Market and Locust Street will need to be cleaned up from the storm and overflow.
Water Committee Report
The slow leak on Sunbury Street will still need to be found with a camera from rural water. A fire hydrant on Stephen and Poplar Street was replaced. They will try to get to another one in September.
Finance Committee Report
2010 audit from Robert Morris was distributed with no issues.
Solid Waste Report
Fall Clean Up is set for 10/15. A new ordinance and contract still needs to be done.
Engineer’s Report
Still waiting on DEP for the decision on the waivers for the water testing. The Act 537 reimbursement application should be done and almost ready to be submitted. Kevin advises we are still waiting on a DBE report from Fulkroad to be submitted to DEP before the notice to proceed on the project can be issued. We are still waiting on one final bill from Kline's then the final draft can be sent to the school district. DEP lost the CCR report from July. Council has authorized Secretary Knellinger to send the report registered mail from now on even though they do not require it.

Mayor Kerns is not in attendance.
Old Business
More research on a leaf vacuum and possible replacement lawn mower for 2012 is needed.
New Business
Councilmember Bill Ritzman made a motion to approve and sign for the purchase of the property adjoining the borough municipal building from Ray Savercool for $92,000. Councilmember Hengst seconded the motion. Approval was unanimous. The agreement of sale will be returned to borough solicitor, Attorney Bunt and the seller's attorney, Robin Holman. A resolution for the extension of life of the Municipal Authority for another 50 years was presented. This is a requirement from Penn Vest because the current agreement will not expire before the new plant upgrade loan is repayed. Councilmember Bill Ritzman made a motion to approve and sign for the extension of the life of the authority another 50 years. Councilmember Hengst seconded the motion. Approval was unanimous.
Chair Tim Reilly of the Municipal Authority informed the council Secretary Dave Briner has resigned from the Authority for health reasons. If a suitable candidate is known, please advise Tim for the open seat. Assistant Secretary Knellinger will continue to perform the duties needed.

Councilmember Ritzman made a motion to adjourn the regular meeting for an executive session. Councilmember Hengst seconded the motion.
